24 NCAC 06A .0225         Denial of Renewal

(a)  The Commission may deny a License renewal based on:

(1)           one or more of the same grounds that would constitute denial of an initial application under Rule .0213 of this Subchapter;

(2)           a violation of the Act or these Rules;

(3)           a pattern of noncompliance with Rules or directives promulgated by the Commission;

(4)           failure to pay the taxes or fees imposed under these Rules;

(5)           the Commission's previous decision to suspend or impose civil penalties on the Responsible Party; or

(6)           a finding by the North Carolina Department of Revenue that the Responsible Party violated a provision in Article 2E of Chapter 105 of the North Carolina General Statutes.

(b)  The Commission may deny a License renewal if the Commission finds good cause that the Responsible Party has not materially complied with one or more provisions of the Act or one or more provisions in these Rules.
